TERMS AND CONDITIONS OF SERVICE FOR DOMAIN AND WEB HOSTING
The use of domain and web hosting services from SiteAWeb Networks Ltd, (hereafter referred to as SiteAWeb Networks) is subject to the following agreement.

It is agreed that customers have read the terms and services before purchasing any service from SiteAWeb Networks. It is also agreed that existing customers and clients have read the update of the terms and conditions of service and both new and old clients and customers are in agreement with the terms and conditions of domain and hosting services provided by SiteAWeb Networks.

Account Setup
Account setup will be done after payment has been confirmed. Your order(s) will be screened in case of fraud.

It is your responsibility to provide us with an e-mail address that will be used for communications. We advice an e-mail address not @ the domain(s) you are signing up under. All e-mail correspondence will be done through this e-mail address. If there is ever an issue, including and not limited to abuse, and we need to contact you, in this case the primary e-mail address here will be used for this purpose. If you choose to change this e-mail address, you must inform us.

We will need a contact person whom privileged information like password can be communicated to. The contact is the one we will deal with. A contact that represents a company or organization is as it is, a contact. We will not deal with another contact for the revelation of privilege information like password except on written notification for a transfer of privilege. We will take the e-mail for the account setup as the email for the contact person. While we guarantee the security of your previleged information like password at our end, we however will not be held liable for any action resulting from misplacement or exposure of information by contact. We will be indemnified for access to your secret information out of a contact negligence. We advice, if you suspect a security threat on the current password you request for change of password.

Domain Name WHOIS Contact Information
SiteAWeb Networks requires that all clients and customers to our domain name services provide their contact information and in accordance with the Internet Corporation for Assigned Names and Numbers ("ICANN"), you must agree to provide certain current, complete and accurate information about you, both with respect to your account information and with respect to the WHOIS information for your domain name(s). You agree to maintain and update this information as needed to keep it current, complete and accurate. You agree that the type of information you are required to provide may change and you understand that, if you do not provide the newly required information, your registration or and/or other service(s) may be suspended or terminated or may not be renewed. Not providing requested information may prevent you from obtaining all service(s).

You may provide information regarding the name-servers assigned to your domain name(s) and, if we are providing name-server services to you, the DNS settings for the domain name. If you do not provide complete name-server information, or if you purchase "Name Only" services, you agree that we may supply this information (and point your domain name to a website of our choosing) until such time as you elect to supply the name-server information or until such time as you elect to upgrade from "Name Only" Services.

Domain Name Hosting
For domain names registered at a third party registrar, you will be responsible for the pointing of the name to our server. You also will be responsible for renewal of the domain name(s) at the third party side. We will however remind you of your hosting expiration with us. We are in no obligation to be informed of redirecting or re-pointing of your domain name(s) by you from a third party registrar to location of your choice, however you agree we will not be answerable to lost of information of whatever kind in this process.

It is your sole responsibility to renew names registered elsewhere which are pointed to our server. We will however remind you of your hosting expiration with us.

Website and Domain Name Transfers
Our technical team will make all effort to assist you to move your website or domain name to our server; however, we cannot make guarantees of the transfer process.

Host Content
All content hosted with our server and/or open for view by anybody shall be for lawful purpose. Use of our services to infringe upon any copyright or trademark is prohibited.
You are responsible for the backup of your content. We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice upon discovery. Failure to respond to e-mail from our abuse department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via e-mail and will have a response within 48 hours. If in doubt regarding the acceptability of your site or service please contact us at abuse@siteaweb.com and we will be happy to assist you.

Email Use
We take a zero tolerance stance against sending of unsolicited e-mail, bulk e-mailing, and spam. "Safe lists" and "double opt-in" will be treated as spam. Any user who we found out sends out spam will have their account terminated with or without notice. SiteAWeb Networks reserves the right to require changes or disable as necessary any website, e-mail pak, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
SiteAWeb Networks reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is entirely at the discretion of SiteAWeb Networks.

Service Cancellation
SiteAWeb Networks reserves the right to cancel your account with us with or without notice if there is a violation of the Terms of and Conditions of Service.
You may cancel your account yourself within 30 days after setup and your refund will be made if over 5% of the account resources have not be used and your reason for cancellation is from our defect. We will not make refund for cancellation after 30 days. To cancel your account, contact customercare@siteaweb.com

Bandwidth Usage
You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting/e-mail package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

Indemnification
Customer agrees that it shall defend, indemnify, save and hold SiteAWeb Networks harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against SiteAWeb Networks, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless SiteAWeb Networks against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with SiteAWeb Networks; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products or service sold to customers through SiteAWeb Networks' e-mail/web server.

Arbitration
By using any of SiteAWeb Networks services, you agree to binding arbitration. If any disputes or claims arise against SiteAWeb Networks or its subsidiaries, such disputes will be handled by an arbitrator of SiteAWeb Networks' choice. All decisions rendered by that arbitrator will be binding and final. You are also responsible for any and all costs related to such arbitration.

Disclaimer
SiteAWeb Networks shall not be responsible for any damages your business may suffer.
SiteAWeb Networks makes no warranties of any kind, expressed or implied for services we provide. SiteAWeb Networks disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by SiteAWeb Networks and its employees.

Disclosure to law enforcement
SiteAWeb may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.

Changes of the Terms and Conditions of Service
SiteAWeb reserves the right to revise its policies at any time without notice. The customer agrees to regularly check for updates of this terms and conditions.
